Terms and conditions for the family salt play room, including house rules

hereinafter “the provider”
Section 2 Scope
(1) These terms apply to all contracts between the provider and consumers (section 13 of the German Civil Code) concerning the use of the family salt play room as well as to reservations and event bookings.
(2) The house rules (Annex 1) in their current version also form part of the contract.
(3) By making a reservation, or at the latest by entering the salt room, the customer accepts these terms including the house rules as binding.
Section 3 Description of services: a pure wellness offering
(1) The provider operates a family salt play room with salty room air and a child-friendly play environment, together with a parent-and-child café.
(2) The offering serves solely wellbeing, relaxation and a shared family experience.
(3) It is expressly a pure wellness offering.
(4) No medical services are provided. No diagnoses, therapies or health claims are made.
(5) Use does not replace medical treatment or advice.
Section 4 Conclusion of contract
(1) The presentation of services on this website does not constitute a binding offer, but non-binding information.
(2) Reservations for the salt room and enquiries about children's birthday parties and groups are made by phone, by message or in person.
(3) The contract is concluded when the provider confirms the reservation, or at the latest when the service is used on site.
(4) No reservation is required in order to use the café.
Section 5 Prices and payment
(1) The prices displayed at the time the service is provided apply, including statutory VAT.
(2) Payment is made on site in cash or by card.
(3) If the customer does not attend a reserved appointment and has not cancelled it, the provider is entitled to allocate the slot to someone else.
Section 6 Right of withdrawal
For leisure services tied to a specific date, there is no right of withdrawal pursuant to section 312g (2) no. 9 of the German Civil Code.
Section 7 Cancellation
Reservations for individual visits can be cancelled free of charge at any time. We ask for a brief message so that the slot can be offered to other families.
For children's birthday parties and group bookings the following applies: cancellation free of charge is possible up to 48 hours before the agreed date. After that, the provider may charge the agreed basic hire fee. Rebooking is subject to availability.
Section 8 Duty of supervision
(1) Children may enter the salt room only when accompanied by a parent or guardian or an adult supervising person.
(2) The duty of supervision remains entirely with the accompanying persons.
(3) Staff do not take on any childcare, monitoring or educational duties.
Section 9 Group and event bookings
(1) The person making the booking is responsible for compliance with the house rules by all participants.
(2) They are liable within the statutory framework for culpably caused damage by the group.
(3) In the event of breaches of the house rules or endangerment of others, the provider may end the event immediately.
(4) In such cases there is no entitlement to a refund.
Section 10 Gift vouchers
(1) Gift vouchers are available from the provider on site and through the provider's online voucher shop. Vouchers issued on site are made out for an amount chosen freely. For purchases in the online shop, the amounts offered there and the conditions displayed there apply.
(2) The provider does not place a time limit on vouchers. Vouchers issued on site simply state the date of issue.
(3) Vouchers can be redeemed for all of the provider's services. In both cases they are redeemed with the provider on site.
(4) Any remaining balance stays on the voucher and can be redeemed on a later visit.
(5) Payment in cash is excluded.
(6) Vouchers are transferable. The provider accepts no liability for the loss of a voucher.
(7) A purchase through the online voucher shop is a distance contract. The statutory right of withdrawal remains unaffected. The exception under Section 6 of these terms applies solely to leisure services tied to a specific date and does not apply to the purchase of vouchers.
Section 11 Photography and video
(1) Recordings are permitted for private purposes only.
(2) Photographing or publishing images of other people's children or guests without their consent is prohibited.
(3) Commercial recordings require the provider's prior written consent.
Section 12 Liability
(1) The provider is liable without limitation in cases of:
- intent,
- gross negligence,
- injury to life, body or health,
- claims under the German Product Liability Act.
(2) In cases of simple negligence, the provider is liable only for breaches of essential contractual obligations (cardinal obligations) and limited to foreseeable damage typical of the contract.
(3) Any further liability is excluded.
(4) In particular, the provider is not liable for:
- risks typical of a play and recreation room,
- guests acting on their own responsibility,
- injuries resulting from disregard of the house rules,
- damage caused by other guests.
(5) No liability is accepted for items brought onto the premises, except in cases of intent or gross negligence.
Section 13 House rights
The provider exercises house rights. In the event of culpable breaches of the house rules, immediate exclusion and a future ban from the premises may be imposed. No refund is given in such cases.
Section 14 Final provisions
German law applies. Should individual provisions be invalid, the remainder of the contract remains effective.
Annex 1: House rules
These house rules are a binding part of the terms and conditions.
1. Access and supervision
- Access to the salt room only after registering at the counter
- Children only when accompanied by an adult
- The duty of supervision remains entirely with the accompanying persons
- No childcare is provided by staff
2. Health
No access with infectious illnesses, fever or open wounds. Use is at your own responsibility. This is not a medical offering.
3. Behaviour
The following are prohibited:
- eating the salt
- throwing salt
- wilful damage
- aggressive or dangerous behaviour
- disregarding instructions from staff
4. Hygiene
- No outdoor shoes in the salt room
- White socks are mandatory in the salt room, bare feet are not permitted
- No food in the salt room
- Drinks only in closed containers, where permitted
- Dogs and other animals are not permitted on the premises
5. Photography and privacy
- Private recordings only
- No publication of images of other people's children without consent
- Commercial recordings only with written permission
6. Groups and parties
- A responsible supervising adult is required
- The person making the booking is liable within the statutory framework
- No open flames, no confetti, no glitter
- In the event of danger or serious disruption, the event may be ended immediately
7. Liability
- Use is at your own responsibility
- No liability for items brought onto the premises
- Parents are liable within the statutory framework for damage caused
